1. Presentation of the Service
Appkina.com (hereinafter “Appkina”) is an online platform that enables users to create, customize, and download their resume in a user-friendly and efficient manner.
Access to and use of the platform are governed by these General Terms of Use (hereinafter “CGU”), which every user accepts without reservation by accessing or using Appkina’s services.
2. Scope of Application
2.1 Purpose
These CGU govern the legal relationship between Appkina and its users, regulating the access to and use of the services and features offered on the platform.
These conditions apply to all uses of the services, whether free or paid.
Appkina reserves the right to modify these CGU at any time. Users will be informed of such modifications by any appropriate means. Continued use of the service after modification constitutes acceptance of the new conditions.
2.2. Scope of Application
Acceptance of the CGU is evidenced by:
- Use of Appkina’s services;
- Creation of a user account;
- Payment of a premium offer, if applicable.
Any user who refuses the CGU must immediately cease using Appkina’s services.
3. Access to the Services
3.1 Conditions of Access
Access to Appkina is available to anyone with an Internet connection and a compatible device. The user is solely responsible for their Internet access and any associated costs.
3.2 Service Availability
Appkina makes reasonable efforts to ensure continuous access to its services. However, the platform cannot be held liable for temporary interruptions, particularly those resulting from:
- Maintenance operations;
- Technical incidents beyond its control;
- Force majeure events;
- Technical failures of its cloud service providers resulting in data loss.
Appkina cannot be held responsible for any data loss resulting from technical issues affecting its hosting and storage providers.
3.3 Access Restriction
Appkina reserves the right to restrict, suspend, or terminate a user’s access in the event of a breach of these CGU, without any obligation to provide justification.
4. Creation and Management of the User Account
4.1 Registration
The user must create an account by providing accurate and up-to-date information. Any identity theft, fraudulent use, or provision of false information may result in account deletion.
4.2 Security of Login Credentials
The user is solely responsible for maintaining the confidentiality of their login credentials (username and password). Any fraudulent use of the account must be immediately reported to Appkina.
5. User Data and Confidentiality
5.1 Collection and Use of Data
The personal data collected by Appkina are used solely for the provision of the services offered and in accordance with applicable data protection laws.
Appkina undertakes not to transfer or sell user data to third parties without the user’s consent.
5.2 Hosting and Security
Data are stored on secure servers protected against unauthorized access. However, the user acknowledges that despite the security measures implemented, no system is infallible.
5.3 Sharing of Resumes and Liability
The user may choose to share their resume by activating a sharing link. Appkina cannot be held liable if a resume or any other data becomes accessible on the Internet as a result of the user activating this link.
6. Responsibilities
6.1 Responsibility of the User
The user is solely responsible for the information they enter on Appkina, particularly that which appears on their resume. The user undertakes not to:
- Publish illegal, defamatory, or infringing content;
- Impersonate another person;
- Disseminate erroneous or misleading information.
Any violation may result in the suspension or deletion of the account, without notice or compensation.
6.2 Responsibility of Appkina
Appkina acts as a technical service provider and does not exercise any editorial control over the content of resumes created by users.
Appkina cannot be held liable for:
- Any use made by the user of their resume;
- The automatic indexing of resumes by search engines;
- Data loss caused by a technical failure of its cloud providers;
- Any data loss resulting from improper user handling.
Any claim relating to the published information is the sole responsibility of the user.
7. Intellectual Property
7.1 Rights to the Platform
Appkina holds all intellectual property rights relating to the website, including the source code, interfaces, graphic design, and any text or visual content created by Appkina.
Any unauthorized reproduction, distribution, modification, or exploitation of the website or its content is prohibited and may lead to legal sanctions under Swiss law.
7.2 User’s Rights to Their Own Content
The user retains full ownership of the content they create via Appkina. However, by creating a resume on the platform, the user grants Appkina a non-exclusive, royalty-free license to host and display the resume for the operation of the service.
8. Pricing and Payment Terms
Appkina offers:
- A limited free account, granting access to the platform’s basic features.
- A premium account at a rate of CHF 9 per month, automatically renewed each month.
8.1 Renewal and Cancellation
- The premium subscription is automatically charged each month.
- The user may cancel their subscription at any time from their personal account area. The cancellation takes effect at the end of the current billing period.
- No partial refunds will be issued in the event of cancellation during the current month.
9. Termination and Deletion of the Account
9.1 At the User’s Initiative
The user may delete their account at any time via their profile settings. This deletion is permanent and results in the removal of all associated data.
9.2 At Appkina’s Initiative
Appkina may suspend or terminate an account in the event of:
- Breach of the CGU;
- Fraudulent behavior;
- Abusive use of the services.
No compensation shall be due to the user in the event of account deletion for violation of these conditions.
10. Applicable Law and Disputes
These CGU are governed by Swiss law.
In the event of a dispute, the parties undertake to seek an amicable resolution before taking any legal action. Failing an amicable agreement, the dispute shall be submitted to the competent courts in accordance with the applicable legislation.
